1. Agreement to these terms

These Terms and Conditions govern your access to and use of Images Upscaler (imagesupscaler.ai), including its website, accounts, image-processing tools, credits, subscriptions, and related services. By using the service, you agree to these Terms. If you do not agree with them, please discontinue use of the service.

When you register, you are asked to confirm that you agree to the website’s Terms and Conditions and Privacy Policy. You must accept both documents to create an account.

2. Eligibility and accounts

You must have legal capacity to enter this agreement and meet any minimum age required in your location. You are responsible for accurate account information, protecting your credentials, activity under your account, and promptly notifying us of suspected unauthorised use. You may not transfer or share an account in a way that compromises security or circumvents service limits.

3. Service and acceptable use

We grant you a limited, personal, revocable, non-exclusive right to use the service in accordance with these terms. You must not use it unlawfully; infringe intellectual-property, privacy, publicity, or other rights; upload malicious or prohibited content; probe or disrupt security; scrape or overload the service; reverse engineer protected portions; evade usage limits; or use automated means except where we expressly permit them.

4. Image upload and processing limits

Each uploaded image may have a maximum file size of 25 MB, and its longest side must not exceed 6,000 pixels. If an accepted image has a longest side greater than 2,500 pixels, we will resize it so that its longest side is 2,500 pixels before upscaling begins.

5. Representational hero imagery

The before-and-after imagery in the landing-page hero section marked “Representational*” is provided only as a visual illustration to help explain what an image upscaler does and what this website is about. It may be staged, simulated, or otherwise prepared for demonstration and should not be treated as an actual processing result, a precise comparison, or evidence of the result you will receive.

Your upscaled images may differ from the hero illustration. Output quality and appearance vary depending on factors such as the source image, its resolution, compression, blur, noise, subject matter, selected upscale level, and the processing model or settings used. The representational hero imagery is not a promise or guarantee of any particular improvement, resolution, detail, or output quality.

6. Your images and content

You retain the rights you have in content you submit. You grant us a limited licence to host, copy, transmit, and process that content only as necessary to provide, operate, secure, troubleshoot, and maintain the requested service. You represent that you have all rights and permissions needed to submit and process the content. You are responsible for downloading and retaining outputs you wish to keep.

7. Downloading your upscaled images

Every download link on the Image Upscaler page is valid for 30 minutes. If a link expires, select Download or Download All again and we will try to create a new link automatically if your images are still available. You may refresh links as many times as needed while the images remain in our temporary storage. Each refreshed link is valid for another 30 minutes. Link refreshing works for both the individual-image Download and Download All controls and applies equally to guests and all logged-in users, including free and paid users.

We keep uploaded and upscaled images for up to 48 hours. Creating a new download link does not extend this storage period. After the temporary image folder expires, the images cannot be refreshed or downloaded again. We will show a message if your images are no longer available. Please download and save any images you want to keep before they are deleted.

8. Free credits

Guests and registered free users may receive welcome credits when they first become eligible and monthly credits while they remain eligible. These credits are provided at no charge as promotional service features. The amount, timing, eligibility, availability, and expiry of welcome and monthly credits may change at any time, and we may limit, suspend, or discontinue these credits. Free credits have no cash value, are non-transferable, and do not create a right to receive future credits.

Welcome credits are supplied once for an eligible free-credit lifecycle. Free monthly credits begin only after the welcome balance has been depleted and the next monthly grant date is reached. Any unused monthly free credits are replaced, rather than accumulated, when a later monthly allowance is granted.

We maintain and reconcile the remaining welcome and monthly balances of matching guest, device, and account records when the upscaler or balance is accessed, when an upscale starts, or when a guest signs in or creates an account. This can reduce a stale free balance or carry forward a genuinely newer monthly grant, and prevents another browser, cleared cookie, or new account from generating a duplicate allowance. Reconciliation does not reduce paid subscription, add-on, or additional credits. See our Privacy Policy for the identifiers and retention involved.

9. Additional credits granted by an administrator

In certain circumstances, an authorised administrator may apply additional credits to your account, for example to resolve a support issue, correct a balance, or provide a discretionary promotion. An administrator may provide these as a one-time credit grant or as a monthly grant. A monthly grant may continue without a specified end date, continue for a fixed number of months, or end on a specified date, including after one month only.

The amount, frequency, start date, and expiry of an administrative grant are determined when it is applied and may be shown in your account. Unused credits from a monthly administrative grant do not carry into the next monthly allowance: the available amount refreshes each month while the grant remains active. These additional credits have no cash value, are non-transferable, and do not create a right to future grants. We may correct, revoke, or end an administrative grant where it was applied in error, its stated period ends, the circumstances for which it was provided no longer apply, or use of the grant violates these terms.

10. Order in which credits are used

When you use a credit-based service, available credits are deducted in this order: (1) free credits, including welcome credits first and then free monthly credits; (2) purchased credits, with subscription credits used before separately purchased add-on credits; and (3) any additional credits applied to your account. Within an add-on category containing more than one purchase, the oldest available add-on credits are used first.

This order reflects how the service currently applies credits and may affect which credits remain in your account after use. Credits that have expired, been revoked, or are otherwise unavailable are not included in the balance used for a request.

11. Upscaling credit charges and batch limits

After every selected image has uploaded successfully, and before image processing begins, we check your then-current credit balance and deduct the full credit cost of the uploaded batch. This rule applies to every user, including guests and logged-in users using free, paid, add-on, or administrator-granted credits. If the balance available at that time is insufficient, the batch is not sent for processing and the images remain unprocessed.

If processing fails for one or more images, credits attributable to those failed images are normally returned automatically. Credits for images that complete successfully are not returned. In a partially successful batch, successful outputs remain available for download and only the credits for the particular failed images are eligible to be returned. A failure to start the processing service normally causes the deducted batch credits to be returned.

An automatic credit return depends on our systems receiving and verifying a reliable failure record. A return may be delayed or may not occur automatically if, for example, the website or processing service is unavailable, a network or callback fails, the processing record is missing, expired, incomplete, or cannot be matched to the request, the user closes or interrupts the session before it synchronises, the account or guest record is deleted or unavailable, or the request involves misuse or an attempt to bypass service limits. Credits are not returned where our records show that the image completed successfully.

Image upscaling may occasionally fail, be interrupted, or produce an error because of technical, network, third-party service, image compatibility, capacity, or other operational issues. We do not guarantee that every submitted image or batch will process successfully.

The number of credits charged per successfully upscaled image may vary according to the selected upscale level, including 2×, 4×, and 8× upscaling. The current credit charge for each upscale level is shown on the Pricing page.

Batch upscaling is subject to limits on the number of images that may be processed together. The current batch image allowances are also shown on the Pricing page. We may increase or decrease credit charges and batch allowances at any time, with or without prior notice. The applicable amounts and limits are displayed on the Pricing page and on the Image Upscaler page when you upscale an image. The amounts and limits displayed at the time you submit an upscale request will apply to that request. You are responsible for reviewing them before using the service.

12. Credits, subscriptions, add-ons, and payment

Prices, included credits (as shown on the Pricing page), billing periods, renewal terms, and applicable taxes are shown at checkout. Paddle is our authorised reseller and Merchant of Record for all orders. Subscriptions renew as disclosed at checkout until cancelled. Cancelling stops future renewals but does not ordinarily reverse charges already completed.

Prices may be displayed and charged in a localised currency by Paddle. Subscription renewals are normally processed in the currency assigned to the subscription and at the recurring price applicable to that subscription. The final amount charged may vary where applicable due to taxes, subscription or plan changes, discounts, payment-method or bank currency conversion, or other adjustments disclosed by Paddle. Purchases and subscriptions are also subject to Paddle’s Buyer Terms.

We may change plan pricing, credit allocations, features, or other plan benefits from time to time. Changes may apply to new purchases or future subscription periods as specified at the time of the change. Where required by applicable law, customers will be provided with notice of changes affecting their existing subscription before those changes take effect.

You can manage your subscription from the Account page. There you can review your current plan and purchases, check billing and purchase details, and cancel an active subscription. Cancellation prevents the subscription from renewing; access and credits remain subject to the expiry rules described in these terms.

An active subscription is required: add-on credits can only be purchased and used while you maintain an active paid subscription. Add-on credit packs are one-time purchases and do not change your subscription renewal date.

Expiry rule: add-on credits remain valid while at least one paid subscription or already-paid subscription period remains active. They carry across plan renewals. If every remaining subscription has renewal turned off, the add-ons remain usable until the latest of those paid periods ends and the Account page may show that final expiry date. Any unused add-on credits are forfeited only after the final qualifying paid period ends.

Refunds and chargebacks may affect subscriptions, service access, and credits. If a subscription transaction is refunded or charged back, only the related subscription ends immediately and will not renew. A separate active subscription, or a separate already-paid period that has not yet ended, continues to keep add-on credits usable. Add-ons are suspended only when the adjusted subscription was the account’s sole qualifying paid subscription; the preserved balance becomes usable again after a new paid subscription starts.

A refund or chargeback of a one-time add-on purchase does not cancel the paid subscription. When a transaction is refunded or charged back, any unused paid credits supplied by that specific transaction are removed; used credits are not restored. Credits supplied by separate transactions or other credit sources are not removed solely because another transaction was refunded or charged back.

For refund eligibility, time limits, request procedures, Paddle’s role, and applicable consumer rights, see our Refund Policy. Credits have no cash value, are non-transferable, and may expire or be limited as disclosed when supplied.

13. Changing, upgrading, or downgrading a paid plan

You can start an upgrade from the Account page, which directs you to the Pricing page to choose and purchase the new plan. You may replace your current paid plan by purchasing a new plan, whether the replacement is an upgrade to a higher-tier plan or a downgrade to a lower-tier plan. The replacement plan starts immediately after checkout, and the credits included with it are added to your available paid credits. Your current plan payment is not refunded merely because you upgrade or downgrade. We will schedule the previous subscription for cancellation so that it does not renew again.

Unused credits from the previous plan remain available until that plan’s existing credit expiry date or billing-period end and are removed only when that date is reached. This also applies when you downgrade; purchasing a lower-tier plan does not cause the previous plan’s unused credits to vanish immediately. The replacement plan has its own credit allowance, billing period, price, and expiry date, regardless of whether it is an upgrade or downgrade. If you cancel the replacement subscription, its unused plan credits remain available until its expiry date and are then removed. If you do not cancel it, the replacement subscription renews on its own due date and the credits for its next billing period are supplied in accordance with that replacement plan. Upgrading or downgrading does not extend the expiry date of credits from the previous plan.

14. Account deletion

Deleting your Images Upscaler account immediately cancels any active paid subscription associated with that account so that it will not renew. Account deletion does not automatically refund subscription charges or other purchases already completed.

When your account is deleted, your entire unused credit balance is permanently removed. This includes credits included with a subscription, free, additional or promotional credits, and any separately purchased add-on credits. Deleted credits cannot be transferred to another account or restored, and no refund or cash payment is provided for them except where required by applicable law. Please use any credits you wish to keep before deleting your account.

Account deletion removes the account profile and cloud image files, but does not necessarily erase every separate record immediately. Upscale processing logs ordinarily expire 60 days after batch creation; a limited deleted-account record may remain for up to 60 days; and credit, billing, transaction, and privacy-protected free-credit matching records may remain longer where needed to prevent duplicate free grants, document activity, prevent fraud, resolve disputes, or meet accounting or legal obligations. 15. Our intellectual property

The service, branding, software, interface, documentation, and all related materials other than your content are owned by us or our licensors. No rights are granted except the limited right to use the service under these terms. Feedback may be used without restriction or compensation, provided we do not identify you without permission.

16. Availability, changes, suspension, and termination

The website and service may occasionally be slow, unavailable, or affected by errors, including during maintenance, updates, high demand, or events outside our reasonable control. We do not guarantee uninterrupted or error-free operation, but we will make reasonable efforts to restore the service and correct issues.

We may change or discontinue features, set reasonable limits, or suspend or terminate access to protect the service, enforce these terms, address risk, or comply with law. You may stop using the service at any time. Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, and liability limitations—will survive.

17. Disclaimers and liability

The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not promise uninterrupted availability or that every output will meet your needs. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Nothing in these terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

18. General terms and contact

If part of these terms is unenforceable, the remainder remains effective. A delay in enforcement is not a waiver. Applicable law and dispute forums are subject to mandatory consumer protections in your location. We may update these terms prospectively and will identify material revisions by the date above.
